JKP to record non-cognizable cases in dedicated registers

SRINAGAR: The government of Jammu and Kashmir has introduced new rules for handling non-cognizable offences, emphasizing accurate record-keeping and timely reporting to magistrates.

As per the Bharatiya Nagarik Suraksha Sanhita, 2023, police stations across the Union Territory will use Register No. 26 to document such cases and forward detailed reports fortnightly to the concerned magistrates, ensuring transparency and accountability in the justice process.

A notification in this regard has been issued by the Home Department.

S.O.— In exercise of the powers conferred under the sub-section (l) of section 174 of the Bharatiya Nagarik Suraksha Sanhita. 2023 read with S.O No. 2506 (E) dated 28.06.2024 of the Ministry of Home Affairs, Government of India, the Government of Jammu and Kashmir hereby make the following rules, namely Information to Court in Non-Cognizable cases and investigation of such cases Rules, 2025.

Every information relating to the commission of a non-cognizable offence received in a police station shall be taken on record by an officer in charge of the Police Station where the information is received and shall be entered in Register No. 26 as per the format given in Annexure ‘A’ appended to these rules.

The information recorded in the aforementioned format shall be forwarded to the Magistrate concerned fortnightly.

The Register No. 26 shall be issued by Police Headquarters of this Union territory of Jammu & Kashmir and the said Register shall be page marked and shall be attested by the Dy.SP, HQ (Deputy Superintendent of Police, Head Quarters) at the opening page as well as on the last page.

As and when the register is complete the same shall be deposited with the Station Clerk of the concerned Police Station against proper receipt.

The request for getting new register shall be made to the office of Deputy Superintendent of Police, Head Quarters. Duties of the officer in charge of concerned police station in respect of forwarding the Daily Dairy report to the Magistrate: The Officer in charge of the concerned police station shall inform the informant that the report/ complaint lodged by him relates to non-cognizable case and he may approach the concerned Magistrate for further proceedings.

The officer in charge of the concerned police station shall ensure that an entry is made in the register regarding the information of non-cognizable offence as stated in rule. The officer in charge of concerned police station shall be responsible to forward the information recorded in Daily Diary Register in such non-cognizable cases to the concerned Magistrate fortnightly.
