Building bye-laws amended: Online- only approvals, green incentives added

Jammu: In a major overhaul of urban construction governance, the Jammu and Kashmir government has amended the Unified Building Bye-Laws (UBBL-2021), introducing a fully digital approval mechanism, stricter compliance norms, and a framework that holds building owners and architects jointly accountable for violations.

The amendments, notified through Standing Order (S.O.) 304 by the Housing and Urban Development Department (H&UDD), are aimed at streamlining building permissions, curbing unauthorised construction and promoting sustainable urban development across the Union Territory.

Under the revised rules, all building plans will be submitted exclusively through an online Building Permission Portal, bringing an end to physical submissions and manual scrutiny.

Applications must be uploaded in AutoCAD format by a Registered Technical Person (RTP), defined as a professionally qualified architect or engineer registered with a central authority.

A central feature of the new system is automated scrutiny, under which building plans will be digitally checked against master plans, zoning regulations, setbacks, height limits and other prescribed norms.

Applications found compliant will be auto-forwarded for approval, while deficiencies will be communicated online. If corrections are not made within 15 days, applications will be automatically rejected.

Officials said the shift to a digital-first system is intended to enhance transparency, reduce delays and minimise discretionary decision-making in the approval process.

In a significant departure from earlier practices, the amended bye-laws establish joint and several liability between the building owner and the RTP. Both parties can be held legally responsible for any deviation from the sanctioned plan, violation of building regulations, or structural defects arising from faulty design or construction.

The provision is aimed at fixing accountability at both ends and discouraging unauthorised alterations during construction.

To further strengthen oversight, RTPs will also act as third-party verification agencies. Through random allocation via the online portal, they may be assigned to inspect construction sites, verify progress and certify compliance before the issuance of occupancy certificates.

The amendments also revise key development norms. Restrictions on ground coverage for several categories of residential plots have been relaxed, while stilt parking within the building envelope has been permitted. The equivalent area can be used as habitable space on the third floor. At the same time, parking requirements have been tightened, making it mandatory for building plans to provide adequate parking space within the plot for all vehicles owned by the resident family. Plans lacking sufficient parking will not be approved.

Sustainability has been formally integrated into the regulatory framework through the introduction of a new chapter on energy conservation and green buildings. Large residential and commercial complexes will now be required to comply with the Energy Conservation and Sustainable Building Code.

Projects achieving higher green ratings, such as IGBC Gold or Platinum or GRIHA four- or five-star certification, will be eligible for incentives including additional floor area ratio, rebates on building permit fees and concessions on annual property tax.

The revised bye-laws also introduce strict timelines for approvals and detailed negative lists for different land-use zones, explicitly prohibiting incompatible or polluting activities in residential and commercial areas to protect neighbourhood character and environmental quality.

Clear enforcement provisions have been laid down for violations, including cancellation of building permits, financial penalties, disconnection of utilities and blacklisting of RTPs found guilty of repeated or serious breaches. All approvals, scrutiny reports and decisions will be maintained in a tamper-proof digital system to ensure traceability.

Commissioner/Secretary, H&UDD, Mandeep Kaur, IAS, said the reforms mark a shift towards transparent, efficient and accountable urban governance, easing procedures for compliant builders while acting as a strong deterrent against illegal construction and promoting sustainable development.

The government said the new online system is expected to go live shortly, marking the end of manual building plan scrutiny in Jammu and Kashmir.
