J&K admin notifies revised ex-gratia norms for L&O disturbance victims

Rs 25 lakh relief for domicile victims; police, SFs, govt employees and civilians covered

Jammu: The Jammu and Kashmir Government has revised and consolidated the norms governing payment of ex-gratia relief to people affected by law-and-order disturbances, including militancy-related incidents, bomb blasts and other acts of sabotage.

The General Administration Department (GAD), in an order issued on Tuesday, superseded Government Order No. 1716-JK(GAD) of 2025 and notified a consolidated set of instructions for sanctioning ex-gratia assistance under the Security Related Expenditure (SRE).

Under the revised provisions, the next of kin of police personnel killed in the course of official duties will be eligible for Rs 5 lakh, while compensation of Rs 75,000 for permanent disability and Rs 10,000 for partial disability has been prescribed. The relief will be sanctioned by the Director General of Police.

The order also provides ex-gratia assistance to police personnel killed or disabled in militancy-related incidents while on duly sanctioned leave, on the same basis as provided under earlier government orders.

For defence personnel and Central Armed Police Forces, the relief for death has been fixed at Rs 5 lakh for non-domiciles killed in J&K.

In the case of J&K domiciles killed in militancy-related incidents, the relief has been fixed at Rs 25 lakh, whether the death occurs within or outside the Union Territory.

Eligible defence and paramilitary personnel suffering permanent disability in J&K will receive Rs 75,000, while those suffering partial disability will be entitled to Rs 10,000. The relief will be sanctioned by the Government in the Home Department and disbursed through the Commandant of the local formation concerned.

The revised rules further extend ex-gratia relief to the next of kin of paramilitary personnel serving in J&K who are killed within the UT in militancy-related incidents while on leave or during inter-station movement on leave.

For government employees other than police personnel, the ex-gratia amount for death has been fixed at Rs 2 lakh for magistrates and Rs 1 lakh for other eligible employees. Permanent disability will attract Rs 75,000, while serious injury requiring hospitalisation for more than 24 hours will qualify for Rs 5,000. Hospitalisation for less than 24 hours will attract Rs 1,000, while minor injuries requiring only first aid will qualify for Rs 500.

For civilians and other persons, relief will be available only where the individual was not directly or indirectly involved in violence or its instigation and was killed, injured or disabled innocently. The ex-gratia amount for eligible deaths, including deaths at the IB/LoC and cases involving surrendered militants and militants who turned informers, has been fixed at Rs 1 lakh.

The Government has also retained provisions for cases where a person is reported missing and the body remains unidentified, subject to an inquiry by the District Magistrate and execution of indemnity and surety bonds.

For damage to immovable property caused by bomb blasts or sabotage, relief will be 50 per cent of the assessed loss, subject to a maximum of Rs 1 lakh.

An aggrieved person can appeal against the Deputy Commissioner’s assessment before the Divisional Commissioner within 30 days.
