SRINAGAR: The Jammu and Kashmir Government has allowed eligible industrial units that failed to submit claims within the prescribed timelines to file their pending claims within two months under existing budgetary support schemes for manufacturing industries.
The Finance Department issued three notifications, S.O. 267, S.O. 268 and S.O. 269, partially modifying existing notifications governing budgetary support to small, medium and large-scale manufacturing units in the Union Territory.
According to S.O. 267, the Government has partially modified SRO 63 of 2018, dated February 5, 2018, concerning budgetary support to manufacturing units through reimbursement of State taxes paid under the Jammu and Kashmir Goods and Services Tax Act, 2017.
Similarly, S.O. 268 partially modifies SRO 519 of 2017, dated December 21, 2017, concerning budgetary support in the form of reimbursement of State taxes paid under the Jammu and Kashmir Goods and Services Tax Act, 2017. S.O. 269 partially modifies SRO 521 of 2017, dated December 21, 2017, concerning reimbursement of 42 per cent of Central Tax paid under the Central Goods and Services Tax Act, 2017.
All three notifications substitute the fifth proviso of Clause 5.1 of the respective schemes to provide relief to eligible industrial units that failed to submit claims within the prescribed timelines before the issuance of the amendments.
The amended provision states that eligible industrial units may avail themselves of the benefits of the schemes by filing their pending claims within two months from the date of issuance of the notifications. This is subject to the condition that all returns due under Section 39 of the Jammu and Kashmir Goods and Services Tax Act, 2017, have been filed and the tax due, along with applicable interest, if any, has been paid.
The notifications also amend Annexure-A of the respective schemes concerning the category of edible oil and vanaspati ghee.
Under S.O. 267, the amendment applies to Entry No. 4 of Annexure-A, replacing the words “Edible Oil and Vanaspati Ghee” with “Edible Oil (except the oil extracted directly from oil seeds) and Vanaspati Ghee”.
Under S.O. 268 and S.O. 269, the same change applies to Entry No. 6 of Annexure-A. The revised wording specifically excludes oil extracted directly from oilseeds from the category mentioned in the provision, while retaining vanaspati ghee.
The notifications state that the amendments shall come into force with effect from the dates of their issuance.
All three notifications were issued by order of the Lieutenant Governor and signed by Shailendra Kumar, IAS, Financial Commissioner (Additional Chief Secretary), Finance Department. Copies have been forwarded to the Financial Commissioners, the Principal Secretary to the Lieutenant Governor, administrative secretaries, divisional commissioners, the Commissioner of the State Taxes Department, the Excise Commissioner and other concerned officials.
