Contention over Rasana Juvenile’s age: On CB’s plea, HC issues notice

JAMMU: In a petition filed by Crime Branch of Jammu and Kashmir Police for setting aside the order of CJM Kathua whereby by virtue of which the age of ‘juvenile’ in Rasana rape-and-murder case has been determined as less than 16 years taking his date of birth as 23-10-2002 which has the effect of declaring him as juvenile and extending him the protection of the Jammu and Kashmir Juvenile Justice (Care and Protection of Children) Act, 2013, the state high court on Thursday has issued notice to the respondent.

While issuing notice, Justice Janak Raj Kotwal observed that Senior Additional Attorney General HA Siddqui has stated in regard to the direction issued by Apex Court by the order dated May 7, 2018 that no court shall entertain any petition pertaining to this case, that the present revision petition is not covered under the purview of the said direction.

Upon this, Justice Kotwal, while keeping this aspect of the matter open for consideration, issued notice to the respondents.
