Unregistered projects fined ₹10 Lakh by JKRERA

Srinagar: In a significant move to tighten regulatory oversight in the real estate sector, the Jammu and Kashmir Real Estate Regulatory Authority (JKRERA) has imposed a penalty of ₹10 lakh on a promoter for failing to register a project as mandated under the Real Estate (Regulation and Development) Act, 2016.

The action came to light during a high-level review meeting chaired by Chief Secretary Atal Dulloo to assess the functioning of JKRERA.

The Chief Secretary underscored the urgent need to strengthen institutional mechanisms, ensure transparency, and protect the interests of property buyers across the Union Territory.

In a detailed presentation, JKRERA Chairman Satish Chandra highlighted the Authority’s ongoing efforts to enforce compliance. Dulloo directed the Housing and Urban Development Department (H&UDD) and allied agencies to extend full support to JKRERA in ensuring that no real estate project operates outside the legal framework.

He also called for fast-tracking infrastructure development for the Authority and resolving inter-departmental coordination issues that hinder effective regulation. Stress was laid on proactive measures to curb unauthorised colonies, especially in rural areas, with Municipal Committees, Development Authorities, and Revenue Departments instructed to work in close coordination.

JKRERA, formally constituted in July 2020 after the extension of RERA to J&K in 2019, holds jurisdiction over all commercial and residential projects except those below 500 square metres or with fewer than eight apartments. Registration of both projects and agents is mandatory, with online and offline modes available for application.

To streamline approvals and enhance accountability, the meeting proposed the introduction of a single-window clearance system, verification of RERA registration prior to property transactions, and better cooperation between departments.

The imposition of the ₹10 lakh penalty marks a strong message from the authorities against non-compliance and reflects a growing emphasis on consumer protection and lawful development in J&K’s real estate landscape.
