HC Summons DC Ganderbal for alleged judicial interference

DCto appear on August 5 for Misconduct, power Misuse Claims

SRINAGAR: The High Court of Jammu and Kashmir on Friday issued summon to the Deputy Commissioner Ganderbal following an alleged misconduct and misuse of power.
The Deputy Commissioner Ganderbal has been asked to appear personally before the High Court of Jammu and Kashmir on August 5th.
A summon has been issued by a division bench of the High Court of Jammu and Kashmir and Ladakh, comprising Justice Atul Sreedharan and Justice Sanjeev Kumar.
The High Court of Jammu and Kashmir in this regard has issued an order which reads, “This is a reference made under Section 15(2) of the Contempt of Courts Act 2015 made by the Chief Judicial Magistrate, Ganderbal in Criminal Reference against Mr. Shyambir, Deputy Commissioner, Ganderbal”.
The contemnor shall appear in person before this Court on Monday i.e., 5th August 2024 at 11:00 am sharp. Any attempt by him to avoid service of summons or his nonappearance shall be viewed seriously by this Court and the Court shall resort to coercive proceedings to secure his presence.
This Court also requests Mr R. A. Jan, learned senior counsel to assist this Court as an amicus. His consent be sought by the Registrar Judicial of this Court.
The order was issued days after a local court in Central Kashmir has initiated contempt proceedings against the Deputy Commissioner of Ganderbal, for his alleged misconduct and misuse of power.
The court of Sub Judge Ganderbal, Fayaz Ahmad Qureshi passed the detailed order on July 23, revealing serious accusations against the Deputy Commissioner Ganderbal, Mr. Shyambir.
According to order, the case in question involves an execution petition filed by decree-holders Noor Mohammad Gojar Chichi and Ghulam Hassan Gojar Chichi, who sought enforcement of a judgment and decree dated October 31, 2022.
The decree, however, according to the court order was not complied with by the judgment-debtors, prompting the execution petition.
The order detailed that Deputy Commissioner Shyambir allegedly engaged in actions intended to intimidate and undermine the presiding judge, who had passed the order against him.
It’s claimed that following the court’s order, Mr. Shyambir “attempted to personally attack the Presiding Officer by scandalizing him and weakening him by manipulation and fabrication.”
The Deputy Commissioner, according to the Court order initiated a series of steps to harass the Presiding Officer, including forming a committee to investigate the judge’s property under ‘dubious’ pretenses.
