ReT teacher charge-sheeted for submitting fake documents

SRINAGAR: The Directorate of School Education Kashmir on Monday terminated two more teachers from remaining un-authorized absent from duties.
The department has further issued a charge sheet to a Rehbar-e-Taleem (ReT) teacher for submitting a fake Date of Birth and Secondary Examination Certificate. Reports said among the two teachers terminated, one remained for more than 19 years.
As per the order issued by the DSEK, Neelofar Jan, Teacher, Primary School PS Khumriyal, Kupwara remained unauthorizedly absent from her legitimate duties w.e.f. 01-07-2002 and the teacher did not resume her legitimate duties and continued to remain unauthorizedly absent for 19 years.
The said teacher as per the order was provided with an opportunity wherein she was directed to present herself before this Directorate along with the statement. The teacher responded to the said notice on 15/07/2021 but on its examination, it was found un-satisfactory/un-substantiated and could not justify her long un-authorized absence, the order reads.
The issue was placed before the Designated Committee and after examining the case the committee took the following decision under process termination under Article-113 J&K CSR of 1956, it added.
Now, therefore, pursuant to the decision of the committee, Neelofar Jan, Teacher, PS Khumriyal, Kupwara is hereby removed from the service of the State in terms of Article 113 of J&K Civil Services Rules (Volume I) of 1956 and rule 30(vii) of J&KCCA rules 1956, it added.
“Whereas, Afroza Ashraf Amin, Teacher, High School HS Nowpora Baramulla remained un-authorizedly absent from her legitimate duties w.e.f. 01-10-2014 and proceeded outside the country without obtaining prior station leave permission/sanction of leave from the competent authority”, the order reads.
The teacher was provided opportunities by the DDO concerned to resume her duties which she failed. Neither the teacher neither presented herself before this Directorate nor responded to these notices, indicating thereby that she is not interested to work in this department, it added.
The issue was placed before the Designated Committee's meeting constituted for the purpose and after examining the case the committee took the following decision "Process for termination be initiated against the teacher as per Article-128 J&K CSR", it reads.
Now, therefore, pursuant to the decision of the committee, Afroza Ashraf Amin, Teacher, HS Nowpora Baramulla is hereby removed from the service of the State in terms of Article 128 of J&K Civil Services Rules (Volume l) of 1956 and rule 30(vii) of J&K CCA rules 1956, it added.
Meanwhile, referring to Nissar Alimad Bauch, Teacher, Zone Beerwah District Budgam in a charge sheet said, “Whereas, you were engaged in the Department as ReT on 15-05-2001 and subsequently regularized after completion of five years as a teacher”.
At the time of your engagement/regularization, you have produced Second, School Examination/Date of Birth Certificate before the Drawing and Disbursing Officer concerned, it reads.
Whereas on the basis of said DOB, the service records were constructed recording therein your Date of Birth in the relevant column and, later on, this Directorate received a complaint alleging therein that you have managed the wrong Date of Birth and the Chief Education Officer Budgam was accordingly requested by this office to furnish original service book/Date of Birth/qualification certificate, it added.
Whereas the Secretary State Board of School Education, Srinagar was requested to verify the genuineness/ particulars of Date of Birth /Second, School Examination Certificate, in response to which the Joint Secret, JKBOSE, Kashmir verified the said certificate and communicated your DOB, it added.
Whereas upon examination of the issue, it reveals that you have produced a fraud and fake Date of Birth/ Secondary School Examination Certificate due to which you managed wrong entry of Date of Birth in your service records by deceiving your superiors/immediate officers which attract action in terms of relevant rules, it reads.
“Now, therefore, before any action in terms of relevant runs is initiated against you, you are hereby charge-sheeted to explain the reasons as to why you have deceived the Department by producing fraud and fake Dan of Birth/ Secondary School Examination Certificate due to which the wrong DOB as "01/04/1968" instead of "01/04/1963" was recorded in your service records”, it added.
“Your reply must reach to this office within 10 days, failing, which it will be construed that you have nothing to say in your defence and action shall be initiated without further notice”
