‘Four copies of Farad Intikhab to be issued, receipt replaces stamp duty’

JAMMU: Even as the lawyers’ strike entered into sixth consecutive day to mark their protest against SAC’s move for creation of a new Department of Registration for registration of various deeds, the Revenue Department today took various measures in issuance of Farad Intikhab and issued printed Mutation Register with 100 leaves each to the Patwaris, thus backing its decision which has taken hostage the work in various courts across Jammu region.
The administration had last month created a separate department of registration, a decision which divested the judicial courts of its powers to register various documents leading to an indefinite strike by lawyers in most parts of Jammu region.
A day after defending its decision through newspaper advertisements, the revenue department has started issuing Mutation Registers to patwaris, beginning with Jammu district, enabling them to register documents pertaining to immovable property like sale, gift, mortgage, lease and bequest.
“Such registers are being published and will be issued to the patwaris of the rest of the districts as department has 1726 Patwar Halqas having 7055 villages in the UT,” official sources said.
They informed The News Now that now onwards, concerned patwaries are issued four hand written Farad Inthikhab copies with unique serial numbers viz- Parat-Sarkar, Parat-Patwar, Parat-Adalat and Parat Soil.
“The four copies of Farad Inthikhab will have photos of concerned patwari, buyer and seller with site of land to be sold. Parat Sarkar copy will be submitted to the Tehsil Office, Parat Adalat copy will be sent to the notified Registrar’s or Sub Registrar’s Offices, Parat Patwar copy will be retained by Patwari and Parat Soil copy will be given to the applicant,” they said.
They said that the government’s stamp duty will be replaced by the amount receipt issued by the revenue department.
“Mutation Register is a printed register with Patwari, separately maintained for each village consisting of normally 100 leaves. Each leaf has a foil and counterfoil and is duly numbered. The title page depicts the name of village, Tehsil, District and date of issue etc. The foil is known as “Parat –Sarkar” and counterfoil as “Parat-Patwar”.
“The parat-Patwar has to be entered by the Patwari as per the existing entries of the Jamabandi and Parat- Sarkar are made as per the orders passed by the Revenue officers on mutations. There are as many as twenty five categories of mutations and before writing up of Jamabandi of any village or mauza, all changes which have taken place in record since the previous Jamabandi, are updated through the orders passed on mutation,” said a senior revenue officer.
Meanwhile, Jammu BAR Association President Abhinav Sharma said that the lawyers would adopt another strategy within days to come.
“Which route we will take, decision in this connection will be taken after two days,” said Sharma when asked about lawyers’ ongoing strike.
The work in High Court and its subordinate courts remained affected for the sixth day on Wednesday following the strike called by Jammu chapter of the Jammu and Kashmir High Court Bar Association (JKHCBA) against the decision.
In a half-page advertisement which had appeared in various local dailies here on Tuesday, the revenue department had highlighted various advantages of separate department of registration in the Union Territory of Jammu and Kashmir.
"The department of registration has been created to make the process similar to the rest of the country. Unlike past the creation of a separate department shall substantially reduce the waiting time for the public in getting various types of deeds or documents registered," the advertisement read.
It said unlike past the applicant would not be required to pay any court fee in addition to the stamp duty payable while registration of a deed for the transfer of immovable property.
"It will ensure easy and direct access to the public with the sub-registrars and registrars. It will enhance transparency and accountability because the revenue officers or officials responsible for issuance of fard intekhab shall be under the direct monitoring and control of the sub-registrars and registrars," the advertisement had said.
It said the new department would also ensure speedy integration of the registration process with mutation of the land records and consequent updating of the revenue records instantly like Jamabandi and record of rights.
It said the revenue officers or officials would be made duty bound to attest the mutation soon after a deed is registered, without asking the applicant to supply the copy of the registered deed separately to the Tehsildar or concerned revenue officer.
