SPCAs Div Com J, K imposed Rs 1000 penalty

JAMMU: The Divisional Commissioners of both Jammu division and Kashmir division today faced wrath of the State High Court over the non-constitution of District Societies for Prevention of Cruelty to Animals (SPCA) in all the 22 Districts of the State, even as the penalty of Rs 1000 each was imposed on the duo.

A Division Bench of the State High Court comprising Chief Justice Gita Mittal and Justice Tashi Rabstan while expressing displeasure over the non-constitution of SPCAs, gave the Divisional Commissioners the last opportunity to comply with the directions issued by this Court vide order dated October, 11, 2017 within a period of four weeks from today.

The court took strong notice of the state’s failure on constitution of society, despite the assurance and undertaking given by Senior AAG Seema Shekhar on October, 11, 2017 when the PIL was disposed of on her assurance that such societies will be constituted in Kashmir as well as Ladakh Region and will also be registered under the Societies Registration Act.

The Division Bench headed by Chief Justice Gita Mittal while expressing anguish over the lackadaisical approach of both Divisional Commissioners Jammu/Kashmir observed that despite repeated reminders by the State Government as well as by the petitioner, incomplete action has been taken till date and in view thereof, the Divisional Commissioners Jammu and Kashmir are given last opportunity to comply with the directions issued by this Court vide order dated October, 11, 2017 within a period of four weeks from today, subject to payment of costs of Rs.1000/- each, to be deposited in the Advocate’s welfare fund.

The contempt petition was filed by SAVE (Save Animal Value Environment), an NGO working for welfare of animals through its Chairperson Devinder Kaur Madaan alias Rumpy Madaan.

Earlier, the Senior AAG Seema Shekhar appearing for GAD submitted that she has filed the compliance report and alongwith the report several reminders are attached which have been repeatedly sent to both the Divisional Commissioners for ensuring the compliance of the court directions.
