JAMMU: A city court on Thursday refused a plea seeking directions to register FIR against National Conference legislator Mohammad Akbar Lone for raising pro-Pakistan slogan in State Legislative Assembly, citing the privileges of Lone as a sitting MLA.

The plea filed by one Shakti Uppal, claiming to be worker of NC, had sought directions from Court in the name of concerned police for registering the FIR against the Lone for committing anti-national activities like slogans " Pakistan Zindabad" in the J&K Assembly Hall on February 10.

Chief Judicial Magistrate Jammu Ashwani Shama while rejecting the complaint observed that is a sitting MLA as such, FIR cannot be lodged against him being a privileged person within the meaning of Section 72(2) of the Constitution of J&K, as such, the court cannot intervene what had happened in the house of the legislature.

In his application, Uppal had alleged that Lone, a former speaker of the house, had shouted antinational slogans in the J&K Assembly Hall at Jammu as like PAKISTAN ZINDABAD" which is clearly against the constitution of India

“Since the said MLA has committed the offence intentionally and deliberately and also to cause loss and damage to the integrity/sovereignty of the country, a strict action under law should be taken against him including to cancel his membership from his party,” he had submitted.

Pertinently, on February 10, the Sonawari MLA had made these contentious remarks following which the BJP MLAs had objected strongly, leading to adjournment of house.

Talking to reporters outside the assembly, Lone had said he had shouted pro- Pakistan slogans only in reaction to the BJP which, he claimed, had shown that they hate Muslims.
