Complaint filed against Farooq, Rishi in Jammu over PoK remarks

JAMMU: In a latest development over the row over the controversial remarks from National Conference president Dr Farooq Abdullah and famous actor Rishi Kapoor on Pakistan occupied Kashmir (PoK), a Jammu based social activist, Sukesh C. Khajuria has filed a complaint with District Magistrate against both of them.
Khajuria, a former member of prominent citizen's advisory committee constituted by J&K government, in an application to the district magistrate, Jammu has sought action under section 196 CrPC against former Chief Minister Farooq Abdullah and Actor Rishi Kapoor for alleged sedition charges for accepting PoK as part of Pakistan .
In the application, he said they should be booked under section 124-A of the Ranbir Penal Code (Sedition) and other provisions of law.
On November 11, Abdullah had told reporters that PoK belonged to Pakistan and "this won't change" no matter how many wars India and Pakistan fight.
In his complaint, Khajuria said Kapoor had backed Abdullah and tweeted that "Jammu and Kashmir is ours, and PoK is theirs. This is the only way we can solve our problem".
In his complaint to Deputy Commissioner, Khajuria stated that the seditious statement made by Dr Farooq Abdullah on Nov 11 and Nov 15, Rishi Kapoor's Tweet on Nov 12, 2017 are an "Incitement to violence" or "Public disorder" and falls within Four Corners and ambit of Section 124-A RPC which falls under chapter VI of the RPC,therefore section 196 of CrPC is attracted.
Sukesh C Khajuria in his complaint had stated that according to the procedure laid down under Section 196 Cr.PC District Magistrate has to file complaint and upon the complaint of the District Magistrate the court shall take cognizance of offence u/s 124-A RPC. From the bare perusal of the complaint and the material enclosed with the complaint, Prima facie case of commission of offence under section 124-A RPC is made out and it warrants indulgence of the DM to file complaint against the accused.
When contacted, Deputy Commissioner Jammu,who is also happens to be DM in Jammu, Kumar Rajiv Ranjan didn't confirm what action he will taken against both Abdullah and Kapoor.
