PoK row: Complaint against Farooq, actor Rishi Kapoor lodged

Jammu, Nov 17: A Jammu-based social activist Sukesh C Khajuria has knocked the door of District Magistrate, Jammu and filed complaint against National Conference President Dr Farooq Abdullah and actor Rishi Kapoor on their remarks on Pakistan-occupied Kashmir.
Mr Khajuria, who is also former member of prominent citizen’s advisory committee constituted by Jammu and Kashmir Government, in an application to the District Magistrate, Jammu has sought action under section 196 CrPC against Dr Abdullah and Bollywood Actor Rishi Kapoor for alleged sedition charges for accepting PoK as part of Pakistan.
In an application to the District Magistrate, Jammu, Mr Khajuria has urged for filing complaint against them for Commission of offence under section 124-A RPC (Sedition) and other provisions of Law.
Referring to recent remarks, Mr Khajuria stated that Dr Abdullah while speaking to reporters on the sidelines of a function at the party headquarters in Srinagar on November 11, again indulged in commission of offence under section 124-A RPC.
It is pertinent to mention here that Dr Farooq had said that PoK belonged to Pakistan and this side (Jammu and Kashmir) to India. "This won’t change. Let them fight how many wars they want to. This won’t change’’, said Dr Abdullah.
He further quoted the NC leader as saying that ‘’Pakistan was “not weak to allow India to take that part of Jammu & Kashmir under its control” while addressing party workers in Uri area of Baramulla District.
The activist in a complaint further lodged that Mr Kapoor backed the National Conference Supremo and tweeted that accepting PoK as part of Pakistan was the only solution to the Kashmir Problem.
"He has also indulged in commission of offence against the state under section 124-A RPC,’’ said Mr Khajuria and added that the seditious statement made by Dr Abdullah and Kapoor was an "Incitement to violence" or "Public disorder" and falls within Four Corners/ambit of Section 124-A RPC which falls under chapter VI of the RPC, therefore section 196 of CrPC is attracted.
"According to the procedure laid down under Section 196 CrPC District Magistrate has to file complaint and upon the complaint of the District Magistrate, the court shall take cognisance of offence u/s 124-A RPC,’’ he maintained.
According to section 3 of the Constitution, Jammu and Kashmir is and shall be an integral part of the Union of India.
Mr Khajuria said that on behalf of the people of India, both houses of the Indian Parliament unanimously adopted a resolution on Feb 22, 1994, emphasising that Jammu and Kashmir has been, is and shall be an integral Part of India, and that Pakistan must Vacate the areas of the Indian State of Jammu & Kashmir, which they have occupied through aggression.
