Court directs SSP to remove I/C PP

Jammu, JULY 27: In a bail application, Principal Sessions Judge Bhaderwah MK Sharma directed SSP Doda to immediately remove Incharge, police post, Kahra from his posting and enquire into the allegations leveled against him by the prosecutrix in her statement recorded under section 164-A Cr.P.C. personally and if the circumstances warrant registration of a separate case against the aforesaid officer or his impleadment as accused in the aforesaid case, then to proceed ahead as warranted under law.
This significant direction has been passed when Court going through the statement of prosecutrix recorded under section 164-A Cr.P.C, where it has been notice the conduct of Incharge, police post, Kahra. The prosecutrix in her statement recorded before the Magistrate under section 164-A Cr.P.C stated that after her recovery from the clutches of the accused, the Incharge, police post, Kahra kept her in his room for a night and made unsuccessful attempt to enter the room. She has further stated that Incharge, police post, Kahra also abused her.
Principal Sessions Judge Bhaderwah MK Sharma after going through the statements of the prosecutrix observed that It is true that section 161 Cr.P.C confers powers on the police to interrogate any witness. However, no male person below 15 years or above the age of 65 years or a woman or a physically or mentally disabled person cannot be called to the police station for investigation. In this age of 21st century, with growing demands for human rights friendly police and judicial administration, the act of the Incharge, police post, Kahra attributed to him by the prosecutrix is not only reprehensible and unbecoming of a police officer but also warrants legal action and directed SSP Doa to immediately remove Incharge, police post, Kahra from his posting and enquire into the allegations leveled against him by the prosecutrix in her statement recorded under section 164-A Cr.P.C. personally and if the circumstances warrant registration of a separate case against the aforesaid officer or his impleadment as accused in the aforesaid case, then to proceed ahead as warranted under law.
