Bail denied in gunshot at Bisnah

Jammu, Jan 21: 1st Additional Sessions Judge Jammu MA Chowdhary rejected the bail application of one Ankush Kumar ( Tony) S/O Harmesh Kumar R/O Mehmoodpur Tehsil Bishnah Distt Jammu who was allegedly involved in gun firing at Bishnah.
According to police case that complainant Parminder Singh resident of Phinder on 29.05.2016 lodgd a written report at Police Station Bishnah alleging that when he was sitting on the road to drink water , one Ravi Kumar started abusing the complainant and all of a sudden fired with his pistol upon the complainant with an intention to kill him and during the course of investigation, Ravi Kumar and Ankush Salgotra alias Tony (applicant/accused) both were found involved in the commission of offences punishable under sections 307/341/504/506/109/34 RPC and 3/27 Arms Act and that the application for grant of bail is not tenable in a case involving the commission of heinous offences including attempt to murder
Court after hearing APP Ajay Singh Manhas appearing for the state whereas Adv Sham Lal appearing for the accused observed that charge against the accused is yet to be considered. The use of a firearm has been shown in the commission of the offence by one of the accused and it has also been alleged that both of the accused including applicant were involved in the commission of offence amongst others an attempt to murder punishable with life imprisonment . The charge is yet to be considered and in my considered opinion , the grant of bail to the applicant/accused at this stage shall be pre-mature particularly so in view of the apprehension that he may jump over the bail and/or also tamper with the prosecution evidence. Therefore, application for grant of bail at this stage is pre-mature and is liable to be rejected. With these observations court rejected the bail application. JNF
