Jammu: After noticing that the some administrative departments are initiating disciplinary action against members of Jammu and Kashmir Administrative Service (KAS) without seeking approval of the Competent Authority, the government of the Union Territory has impressed upon all the administrative secretaries the to ensure that the disciplinary proceedings will be initiated only after following due process.
“It has been observed that some Administrative Departments are initiating disciplinary proceedings against the members of lammu and Kashmir Administrative Service without seeking approval of the Competent Authority. All such orders/ Acts without the approval of Competent Authority are not legally tenable and may lead to administrative complicacies,” reads the order.
“In terms of Rule 31 of the Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956, the appointing authority or any authority to which it is sub-ordinate or any other authority empowered by the Government in this behalf may place a Government servant under suspension,” the order further reads.
“In terms of the 'Procedure for Transaction of Government Business of Union territory of Jammu and Kashmir' notified vide Government Order No. 811-JK(GAD) of 2020 dated 01.09.2020, the cases regarding disciplinary action against KAS Officers are required to be placed before the Hon'ble Lieutenant Governor through the Chief Secretary in coordination,” the order reads.
“Accordingly, all' the Administrative Secretaries/ HoDs are once again impressed upon to ensure that the disciplinary proceedings proposed against members of Jammu and Kashrnir Administmtive Service are initiated only after following due process and with the approval of Competent Authority,” the order reads.
