RERA implemented, 12 Laws repealed

Jammu: The Centre on Tuesday amended the Jammu and Kashmir Development Act, 1970 for setting up an industrial development corporation for rapid establishment, growth and development of industries in the union territory.

The amendment to the Act was made through a notification issued by the Ministry of Home Affairs, which inserted a new chapter in the law for setting up the Jammu and Kashmir Industrial Development Corporation.

According to the notification, the Jammu and Kashmir Industrial Development Corporation will be set up for the purposes of securing and assisting in the rapid and orderly establishment, and organisation of industries in industrial areas and industrial estates in the union territory.

It will also help in establishing commercial centres in connection with the establishment and organisation of such industries.

The corporation shall acquire and hold such property, both movable and immovable, for the performance of any of its activities, and to lease, sell, exchange or otherwise transfer any property held by it on such conditions as may be deemed proper, the notification stated.

It will establish and manage industrial estates, develop industrial areas and make them available for undertakings to establish themselves.

The Ministry of Home Affairs (MHA) issued a notification repealing 12 laws completely, which were enacted by the erstwhile state of Jammu and Kashmir, while 14 Acts have been retained with some modifications.

The order issued on Gazette of India, under provisions of the Union Territory (UT) of Jammu & Kashmir (J&K) Reorganisation (Adaptation of Central Laws), said “The Real Estate (Regulation and Development) Act (RERA), 2016 will now be applicable in the UT and Section 86- In sub-section (2), for -the Union territory Government of Puducherry occurring at both the places, substitute,-the Union Territory Government of Puducherry or the Union territory Government of Jammu and Kashmir".

In the operation of Code of Criminal Procedure, the order said, the words Joint Director to substitute with Director Prosecution. As per the order the expression Ranbir Panel Code has been replaced with Indian Penal Code (IPC) throughout the Jammu and Kashmir Aerial Ropeways Act-2002 and in case of the Jammu and Kashmir Agrarian Reforms Act – 1976 the word state has been substituted with Union territory, the notification said.

The erstwhile state laws, which are completely repealed, include the Jammu & Kashmir Alienation of Land Act, the Jammu & Kashmir Big Landed Estates Abolition Act, the Jammu & Kashmir Common Lands (Regulation) ACT, 1956 and the Jammu & Kashmir Consolidation of Holdings Act, 1962.

Similarly, the Jammu & Kashmir Flood Plain Zones (Regulation and Development) Act, the Jammu & Kashmir Land Improvement Schemes Act, the Jammu & Kashmir Prevention of Fragmentation of Agricultural Holdings Act, the Jammu & Kashmir Prohibition on Conversion of Land and Alienation of Orchards Act, the Jammu & Kashmir Right of Prior Purchase ACT, the Jammu & Kashmir Tenancy (Stay of Ejectment Proceedings) Act, the Jammu & Kashmir Utilization of Lands Act and the Jammu & Kashmir Underground Public Utilities (Acquisition of Rights of user in Land) Act have also been completely repealed.

Besides these, the MHA order has replaced the expression the State with ‘Union Territory’ like in case of the Jammu & Kashmir Agrarian Reforms Act, the Jammu & Kashmir Land Grants Act and the Jammu & Kashmir Development Act in the 14 laws.
