JKP clarifies on Gangyal assault case

JAMMU: A day after allegedly beating a contractor brutally for stopping his car on the road during a VIP convoy movement, the police on Tuesday said it has registered a case against him for drunk driving, and seized his vehicle.

It also said that the person in questioned misbehaved with the policemen on duty, but didn’t mention about the injuries to him.

The action on the part of police came after the matter was put in public domain by certain sections of media.

In a horrific incident, Rohit Jamwal of Birpur, waiting in a car on the road was allegedly beaten black and blue, after he failed to notice the signal of some policemen asking him to move his vehicle in Gangyal.

Rohit, who lost consciousness due to brutal assault, was later admitted to the Gandhi Nagar hospital where doctors, after seeing his condition, referred him to the Government Medical College and Hospital for advance treatment.

In a statement today, police said that on January 19, a police party of PS Gangyal, while on duty at Gangyal chowk for safe crossing of VIP movement, came across a vehicle bearing registration number JK21A 8808 on the road.

“The driver, namely, Rohit Jamwal, appeared to be under the influence of intoxicants. On being asked to remove the vehicle, the said person refused and started creating disturbance on the route.

“As a result, he was detained and sent for medical examination, and the vehicle was seized. The medical examination of the said person was conducted at Government Hospital Gandhi Nagar, where the report by the CMO stated that the said person had consumed alcohol,” it said.

Based on this, a report U/S 36 of Police Act was registered and Jamwal was released on personal bond, while the vehicle was seized, it added.

The Section 36 of Police Act deals with punishment for certain offences on roads, and gives the Police Officers power to detain without warrant a person who, on any road or in any open place or street or thoroughfare within the limits of any town creates obstruction, inconvenience, annoyance, risk, danger or damage of the residents or passengers.

A subsection further states that any person who is found drunk or riotous or who is incapable of taking care of himself can be taken into custody.

The incident had taken place on Sunday in Gangyal area of Jammu.
