Yasin Mailk to appear in TADA Court on June 8

JAMMU: TADA court Jammu on Tuesday issued notice to Jammu and Kashmir Liberation Front (JKLF) Chief Mohammad Yaseen Malik for his alleged involvement in the kidnapping of Dr. Rubiya Syed and killing of Air Force personals in 1990s.

Along with Malik, the Presiding Officer of TADA Court also issued notices to Ali Mohammad Mir, Mohd Zaman Mir, Iqbal Ahmed Gandroo, Javed Ahmed Mir, Manzoor Ahmed Sofi, Wajahat Bashir Quresi, Mehraj-ud-Din Sheikh, Showkat Ahmed Bakshi, and Nanaji.

The State High Court in April had dismissed an appeal by Malik seeking transfer of the trial of these two TADA cases against him to Srinagar by striking down a 2008 order that had transferred their hearing to Srinagar.

The TADA court on May 11 had asked the CBI to produce Copy of order of Jammu and Kashmir High Court whereby it had vacated the stay on the proceedings in both these cases.

Today when the matter was taken-up, Public Prosecutor CBI submitted a copy of order passed by the High Court following which the TADA court issued notice to the accused for their presence on June 8, 2019.

The first case relates to an incident that occurred on January 25, 1990 at Rawalpora, Srinagar. Air Force employees were fired upon by terrorists in which 40 of them, including a woman, received serious injuries and five IAF personnel were killed on the spot.

On completion of investigation, a charge sheet was filed on August 31, 1990 against Malik and five others before the designated TADA Court at Jammu.

The second case relates to the kidnapping of Dr Rubiya Syed. She was going to her house at Nowgam when she was abducted by some unidentified terrorists travelling in the same mini bus. She taken to some unknown place and they threatened to kill her in case their demands were not met. They created terror among the passengers by brandishing gun and pistols.

Malik is presently lodged in Delhi's Tihar Jail after he was shifted from Jammu's Kot Balwal jail by the National Investigation Agency (NIA) in connection with the terror funding case being investigated by the agency.

A court in Delhi has remanded Malik to judicial custody till May 23.
