JK HC directs FC Revenue to consider Rules, seniority for promotion strictly
19 I/c Naib Tehsildars challenge Recruitment Rules

JAMMU: In a writ petition filed by 19 Incharge Naib Tehsildars of Jammu Division challenging Rule 20 of Jammu & Kashmir Civil Services Decentralization and Recruitment Rules 2010, Justice Mohd Yaqoob Mir of J&K High Court, Jammu Wing, has directed that in case Financial Commissioner, Revenue, J&K Government, contemplates to consider the cases for promotion to the post of Naib Tehsildar, relevant rules and the position of seniority shall be strictly followed.
After hearing Advocate Sheikh Shakeel Ahmed with Advocate Sheikh Najeeb Ashraf appearing in a writ petition filed by 19 I/c Naib Tehsildars titled Mohd Salim & Others Vs State of J&K & Others, Justice Mohd Yaqoob Mir issued notices to Commissioner Secretary GAD, Commissioner Secretary Law Department, Commissioner Secretary Revenue Department, Financial Commissioner Revenue J&K, Divisional Commissioners Jammu / Kashmir returnable by or before the next date of hearing i.e., February 21, 2018.
Advocate S.S. Ahmed appearing for the petitioner submitted that the post of Naib Tehsildar is a State Cadre post and promotion to the said post is to be made from amongst the confirmed Girdawars of both Jammu and Kashmir Divisions.
